Home Rental Terms & Conditions (Long-Term & Short-Term)

This document outlines the standard terms and conditions for residential home rentals managed or facilitated by Travel Adventure Orb Sdn Bhd (hereinafter referred to as "the Agent") for both long-term and short-term tenancies in Malaysia.

⚖️ 2026 Legal Notice: In accordance with prevailing Malaysian law, including the Contracts Act 1950 and the Specific Relief Act 1950, the executed and stamped Tenancy Agreement serves as the primary contractual document governing the rights and obligations of the parties.

1. Definitions

  • Tenant/Renter: The individual(s) or legal entity renting the property.
  • Owner/Landlord: The registered legal owner of the property.
  • Agent: Travel Adventure Orb Sdn Bhd, acting as the corporate property manager, intermediary or liaison where appointed.
  • Property: The specific residential unit, parcel or house being leased.

2. Rental Agreement & Court Enforceability

A formal written Tenancy Agreement should be executed by both the Tenant and the Owner. Where applicable, the agreement should be properly stamped in accordance with the applicable Malaysian stamp duty requirements.

The Tenancy Agreement shall remain the principal document governing the tenancy, including rental amount, deposit, tenancy duration, termination provisions, responsibilities of the parties and other agreed conditions.

3. Rental Duration Categories

  • Short-Term Rental: Any tenancy lasting for a duration of less than six (6) consecutive months.
  • Long-Term Rental: Any tenancy lasting for six (6) months or longer, typically one (1) to two (2) years.

4. Standard Deposit Structure & Payment Terms

Unless explicitly modified in the special conditions of the final signed agreement, the standard upfront financial requirements are structured as follows:

Security Deposit Equivalent to 2 months' rent Refundable within 14–30 days after tenancy completion, subject to deductions for verified property damage beyond reasonable fair wear and tear.
Utility Deposit Equivalent to 1 month's rent Refundable after verification and settlement of all final outstanding utility bills, where applicable.
Advance Rent Equivalent to 1 month's rent Applied directly toward the first month of occupancy.

Payment Method

All rental transactions should be executed through direct online bank transfer or other approved banking channels. Cash payments are discouraged in order to maintain a transparent accounting and payment record.

5. Tenant Responsibilities

The Tenant agrees to:

  1. Maintain the interior of the property, including fixtures, furniture and appliances, in a clean, tenantable and hygienic condition.
  2. Pay all applicable monthly utility fees, including electricity, water, sewerage and internet charges incurred during the tenancy.
  3. Provide prompt written notice to the Agent or Owner regarding structural defects, water leaks or major maintenance requirements.
  4. Refrain from subletting, assigning or transferring possession of the property, whether in whole or in part, without prior written consent from the Owner.

6. Owner Responsibilities

The Owner agrees to:

  1. Hand over the property in a reasonably habitable, secure and clean condition on the agreed move-in date.
  2. Remain responsible for major structural repairs, external piping, roof leaks, foundational issues and main electrical systems, except where damage is caused by tenant negligence or misuse.
  3. Maintain applicable property-related payments and charges for which the Owner is legally or contractually responsible.

7. Termination of Lease & Legal Eviction Constraints

  • Short-Term Rental Termination: Either party may initiate termination by providing a minimum of thirty (30) days' written notice, subject to the signed agreement.
  • Long-Term Rental Termination: Termination requires a minimum of sixty (60) days' written notice, subject to the terms of the Tenancy Agreement.
  • Early termination may result in deposit forfeiture or other contractual penalties where expressly provided in the signed Tenancy Agreement.
⚠️ Important Eviction Notice: Landlords and tenants should follow the applicable Malaysian legal process and the terms of the signed Tenancy Agreement when dealing with possession, termination or eviction matters. Parties should obtain appropriate legal advice where a dispute arises.

8. Corporate & House Rules

  • Prohibited Activities: The property must be used for lawful residential purposes. Illegal activities, commercial operations without authorization, gambling, drug-related offences and activities causing public nuisance are prohibited.
  • Pets: Domestic pets are not permitted unless expressly authorized in writing by the Owner.
  • Smoking Policy: Smoking is prohibited inside enclosed indoor areas of the property.

9. Agent’s Role & Service Tax Compliance

Travel Adventure Orb Sdn Bhd may act as an intermediary, coordinator or property management liaison where appointed by the Owner.

The Agent's role may include:

  • Drafting and coordinating tenancy documentation.
  • Coordinating the collection and disbursement of deposits and rental payments where authorized.
  • Acting as a communication intermediary for maintenance requests and operational matters between the parties.
  • Tax Note: Any agency, management or related service fees may be subject to applicable Malaysian taxes and regulations.

10. Governing Law

This document and the underlying tenancy are governed by the laws of Malaysia. Any unresolved disputes should first be addressed through communication and, where appropriate, mediation or professional legal advice before proceeding through the applicable Malaysian legal system.


Required Documentation Checklist

For the Tenant:

  • Clear copy of MyKAD/NRIC for Malaysian citizens OR valid Passport and applicable Visa/Employment Pass for foreigners.
  • Verifiable proof of financial income, where requested.
  • Employment verification letter or valid student identification, where applicable.
  • Reference history from a previous landlord, where available.

For the Owner:

  • Clear copy of MyKAD/NRIC of the property owner.
  • Proof of property ownership, such as Strata Title, Land Title or relevant ownership documentation.
  • Latest utility bills, where applicable.
  • Most recent management or maintenance fee receipts, where applicable for stratified properties.

For the Agent (Travel Adventure Orb Sdn Bhd):

  • Signed corporate Letter of Authorization empowering the Agent to list and manage the specific property.
  • Comprehensive digital or physical Move-In/Move-Out Inventory Checklist supported by dated photographic evidence where applicable.
